Your access to, browsing and use of, Our Site is subject to these terms of use and other documents referred to within them (Terms of Use), whether as a guest or a registered Member or Affiliate Member of RDI.

By using Our Site, you consent to such processing and you warrant that all data provided by you is accurate. If you are (or would like to become) a registered Member or Affiliate Member of RDI and you purchase membership or other services from Our Site, Our Membership Terms and Conditions will apply to the sales.

 

ACCESSING OUR SITE

Save for membership registration, log-in areas and chargeable services accessible from those areas, our Site is offered as a free information service to you. It is directed solely at those who access Our Site worldwide.

We do not guarantee that Our Site, or any content on it, will always be available or be uninterrupted. Access to Our Site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of Our Site without notice. We will not be liable to you if for any reason Our Site is unavailable at any time or for any period.

You are responsible for making all arrangements necessary for you to have access to Our Site. You are also responsible for ensuring that all persons who access Our Site through your internet connection are aware of these Terms of Use and other applicable terms and conditions, and that they comply with them.

 

YOUR ACCOUNT AND PASSWORD

If you choose, or you are provided with, a user identification code, password or any other piece of information as part of Our security procedures, you must treat such information as confidential. You must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by Us, at any time, if in Our reasonable opinion you have failed to comply with any of the provisions of these Terms of Use.

If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us at info@rdi-online.co.uk .

 

INTELLECTUAL PROPERTY RIGHTS

Except as otherwise indicated on Our Site, We are the owner or the licensee of all intellectual property rights in Our Site, and in the material published on it, including but not limited to copyright, moral rights, domain names, registered and unregistered trademarks, service marks, logos and database rights. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. Our Site must not be proxied or mirrored without Our prior written consent. You may print off one copy, and may download extracts, of any page(s) from Our Site for your personal use and you may draw the attention of others within your organisation to content posted on Our Site.

Our status (and that of any identified contributors) as the authors of content on Our Site must always be acknowledged. If you print off, copy or download any part of Our Site in breach of these Terms of Use, your right to use Our Site will cease immediately and you must, at Our option, return or destroy any copies of the materials you have made.

 

NO RELIANCE ON INFORMATION

The content on Our Site is provided for general information only. It is provided on an “as is" basis and it is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on Our Site. Whilst We use reasonable efforts to include accurate and up-to-date information on Our Site, We make no representations, warranties or guarantees, whether express or implied that the content on Our Site is accurate, complete or up-to-date.

UPLOADING CONTENT TO OUR SITE

Whenever you make use of a feature that allows you to upload content to Our Site, or to make contact with other users of Our Site, you must comply with the content standards set out below. You warrant that any such contribution does comply with those standards, and you will be liable to Us and indemnify Us for any breach of that warranty. If you are a consumer user, this means you will be responsible for any loss or damage We suffer as a result of your breach of warranty. Any content you upload to Our Site will be considered non-confidential and non-proprietary, and We have the right to use, copy, distribute and disclose to third parties any such content for any purpose.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to Our Site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any content posted by you or any other user of Our Site. We have the right to remove any posting you make on Our Site if, in Our opinion, your post does not comply with the content standards set out below. The views expressed by other users on Our Site do not represent Our views or values.

 

VIRUSES

Whilst We try to keep Our anti-virus software up-to-date, We do not warrant or guarantee that Our Site, its server, downloadable files or emails which We may send to you will be secure or free from bugs, viruses or other harmful components. You are responsible for configuring your information technology, computer programmes and platform in order to access Our Site. You should use your own virus protection software. You may link to Our home page, provided you do so in a way that is fair and legal and does not damage Our reputation or take advantage of it. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on Our part where none exists. Where Our Site contains links to other sites and resources provided by third parties, these links are provided for your information only and do not necessarily imply an endorsement from Us. We have no control over the contents of those sites or resources and We cannot accept any responsibility for them. Hypertext links are links by which visitors can move from one website to another or from one page to another within the same website. Deep links are hypertext links which take visitors into a particular page on a website whilst bypassing the homepage of that website. Our Site contains hypertext links to third parties' websites. Any hypertext links and deep links between Our Site and any third party website are provided for your convenience only and We accept no liability whatsoever for the contents of any such third party website. We exclude, to the fullest extent permitted by law, all liability that may arise in connection with or as a result of third party website material causing any damage, costs, injury or loss of any kind.

Please note when you link to a third party website the provisions of Our Privacy Policy do not apply to any personal data collected and processed by that website's operator.

 

PROHIBITED USES

You may use Our Site only for lawful purposes. You may not use Our Site:

Similarly, we may also provide Twitter and other social media feeds (Feeds) on Our Site which automatically display live content that users of such social media have uploaded about Us and Our services. Accordingly, we have no control whatsoever over the Feed content displayed on our Site, although We do try to monitor our social media pages as regularly as possible. Where We do provide any Interactive Service, We will provide clear information to you about the kind of service offered, if it is moderated and what form of moderation is used (including whether it is human or technical). We will do Our best to assess any possible risks for users from third parties when they use any Interactive Service provided on Our Site or in relation to Feeds displayed on Our Site, and We will decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in the light of those risks.   • Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety.

  • Be likely to harass, upset, embarrass, alarm or annoy any other person.

  • Be used to impersonate any person, or to misrepresent your identity or affiliation with any person.

  • Give the impression that they emanate from us, if this is not the case.

  • Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

 

SUSPENSION AND TERMINATINON

We will determine, in Our discretion, whether there has been a breach of these Terms of Use through your use of Our Site. When a breach of these Terms of Use has occurred, We may take such action as We deem appropriate.

Failure to comply with these Terms of Use may result in Our taking all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use Our Site and any membership which you hold with RDI.

  • Immediate, temporary or permanent removal of any posting or material uploaded by you to Our Site.

  • Issue of a warning to you.

  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.

  • Further legal action against you.

  • Disclosure of such information to law enforcement authorities as We reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of these Terms of Use. The responses described in this policy are not limited, and We may take any other action We reasonably deem appropriate.

You agree to indemnify and keep Us, Our officers, directors, agents, licensors, successors and assigns indemnified against all liabilities, claims, losses, costs, damages and expenses including legal fees incurred by Us should you breach any of these Terms Of Use. We reserve the right to assume the defence and control of any matter subject to indemnity by you and, in such case, you undertake to cooperate in full with our defence of any such claim.

Please check this page from time to time to take note of any changes made as they are binding on you. We may update Our Site from time to time, and may change the content at any time. However, please note that any of the content on Our Site may be out of date at any given time, and We are under no obligation to update it. The headings in these Terms Of Use are for convenience only and shall not affect the meanings of these Terms Of Use. Each of the paragraphs of these Terms of Use operates separately. If any paragraph of these Terms of Use is deemed unenforceable by a court or any other relevant authority, it shall not affect the enforceability of the remaining paragraphs. If you are a consumer, please note that these Terms of Use, their subject matter and their formation, are governed by English law. You and We both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland. If you are a business, these Terms of Use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
